PRIVACY POLICY FOR PERSONS SUBMITTING INQUIRIES, REQUESTS OR COMPLAINTS

UAB “Omberg group” is committed to protecting your information. We adhere to the General Data Protection Regulation (GDPR) of the European Union as well as other laws that protect your information that we collect, use and store at our Company.

1. How should I read this Privacy Policy?

This Privacy Policy will answer the most important questions on how we collect, use and store information about you. If you have any questions or any part of this Privacy Policy is unclear, our Data Protection Coordinator is ready to assist you, as described in Section 9 hereof. Please note that any form of the term ‘we’ in this Privacy Policy refers to our Company, as set out in Section 2 hereof.

3. Why do you collect information about me? What is the legal basis for collecting, using and storing my information?

PURPOSE OF COLLECTION, USE AND STORAGE OF DATA LEGAL BASIS FOR COLLECTION, USE AND STORAGE OF DATA
to be able to properly administer inquiries, requests and complaints we receive and prepare responses to them we have a legitimate interest to administer incoming requests, complaints and inquiries and prepare responses to them (Article 6(1)(f) of the GDPR), and to the extent such requests, inquiries and/or complaints are related to the performance of the concluded contract or the wish to conclude a contract, the administration of such requests, inquiries or complaints is necessary for the proper performance of contracts concluded by us or for the assessment of possibility to conclude a contract with you (Article 6(1)(b) of the GDPR);
we are subject to a legal obligation to store the company’s business documents your personal data is required for the compliance with our legal obligations to archive the company’s business documents (Article 6(1)(c) of the GDPR);
for the defence of our legitimate interests – if necessary, we may use your personal data to defend our legitimate interests, including our reputation, in courts, pre-trial dispute settlement institutions and other competent authorities we have a legitimate interest to protect our rights and interests in courts, arbitration and pre-trial dispute settlement institutions (Article 6(1)(f) of the GDPR).

4. What information I would have to provide to you and why?

When submitting an inquiry using our website’s inquiry form, contact e-mail addresses provided on our website or by post, you should indicate your name, surname, e-mail address or other contact details, the subject of the inquiry and information relevant to the inquiry. If you submit an inquiry, we may request additional information about you so that we can respond to your inquiry appropriately.

5. Do you collect sensitive information about me?

Your sensitive information (information about racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, data about a natural person’s sex life and sexual orientation) is not collected and if it is not relevant to the complaint, request or inquiry you have submitted or are planning to submit, please do not provide it. If such information is nevertheless provided, we will assume that you have given us your consent to the processing of this information (Article 9(2)(a) of the GDPR).

6. Do you share my information with others?

Information about you may be transferred to: 

  • companies providing legal services, law firms, courts (arbitrations) or pre-trial dispute settlement institutions, to the extent necessary to obtain legal aid or to defend legitimate interests;
  • bailiffs, to the extent this is necessary for the performance of duties established by legal acts or for the execution of decisions of courts/pre-trial dispute settlement institutions;
  • our service providers, i.e. companies providing communication (e-mail), data storage, customer management platform services.

7. How long do you store my information?

Your information will be stored:

  • if your inquiry relates to a contract that we have concluded or are planning to conclude, we will store it for 10 years after the expiry of the contract;
  • if you have submitted a complaint, request or other inquiry that is not related to the conclusion or performance of a contract, we will store it for 1 year from the date of adoption of the decision in our company;
  • documents submitted to courts or other dispute settlement or law enforcement authorities will be stored for 1 year after the adoption of the final decision;
  • court enforcement orders and bailiffs’ orders will be stored for 10 years after the end of payments.

8. What actions can I take with regard to my information at your company?

If you would like to take any of the steps listed below, please contact us as indicated in Section 9. Please note that these rights are subject to conditions and exclusions provided for in the legislation:

  • submit a request for the access to your information if we process your personal data that can be used to identify you;
  • submit a request for the rectification or completion of your information;
  • submit a request for the erasure of your information if:
  1. we process your data on the basis of consent;
  2. we process your data unlawfully;
  3. your data is processed on the basis of our legitimate interest and you challenge our legitimate interest;
  4. your data are no longer necessary in relation to the purposes for which they were collected;
  5. we are subject to a legal obligation to erase information about you;
  • submit a request for the restriction of processing of your information if you dispute the accuracy of data or object to the processing of data, do not consent to the deletion of your data processed unlawfully, or need the data for the establishment, exercise or defence of legal claims;
  • object to the collection, use and storage of your information at our company when we use legitimate interest as a basis for the processing of your data;
  • submit a request for the export of your data if you have submitted the data to us in a structured, commonly used and machine-readable format and have given your consent to the processing of such data or we have to process these data for the performance of a contract with you;
  • withdraw your consent to the processing of your personal data at any time;
